Agreement to terms.
By downloading, installing, or using Home Gym Buddy ("HGB", "the app"), you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the app. The app is free of charge and there is no penalty for walking away.
These Terms form a binding agreement between you and Fabien G., an individual developer ("we", "us", "developer"), who is the licensor of the app.
Relationship to Apple's standard EULA.
Home Gym Buddy is distributed through the Apple App Store. In addition to these Terms, the Apple Media Services Terms and Conditions and the standard Apple Licensed Application End User License Agreement (the "Apple EULA") apply to your use of the app. The Apple EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula.
In the event of any conflict between these Terms and the Apple EULA, the more restrictive provision regarding your conduct shall prevail, and the more protective provision regarding your rights as a consumer shall prevail.
You acknowledge that Apple is not a party to these Terms and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you.
License.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use Home Gym Buddy on any Apple-branded device that you own or control, in accordance with the Usage Rules set out in the Apple Media Services Terms.
This license is for your own personal use. You may not sublicense, sell, rent, lease, lend, redistribute, or commercially exploit the app or any part of it.
Age.
You must be at least 13 years old to use Home Gym Buddy. If you are between 13 and 18 (or the legal age of majority in your jurisdiction, if higher), you should review these Terms with a parent or guardian before using the app. By using the app you confirm that you are old enough to do so.
Acceptable use.
You agree not to:
- Copy, modify, translate, adapt, or create derivative works of the app, except as expressly permitted by these Terms or by law
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent such restriction is prohibited by applicable law
- Remove, obscure, or alter any proprietary notices in the app
- Use the app in any unlawful manner, or in connection with any unlawful activity
- Use the app in any way that could damage, disable, overburden, or impair Apple's services
Health & training disclaimer.
Home Gym Buddy is a tool. Nothing more. It helps you organise and follow a workout program that you have built yourself. It does not provide fitness advice, training guidance, exercise recommendations, programming, coaching, or anything that should be interpreted as instruction on how to train.
You are fully responsible for your own program and your own health. You decide the exercises, the weights, the sets, the reps, the schedule, and whether any of it is appropriate for your body on any given day. We simply display what you put in.
We are not trainers, coaches, physiotherapists, doctors, or medical professionals of any kind. The app is not medical advice and is not a substitute for medical advice. If you have any condition, injury, or concern, or if you are unsure about any aspect of your training or health, consult a qualified professional before using this app or any exercise program.
By using Home Gym Buddy, you accept that all decisions about your training are yours alone, and that the developer bears no responsibility for any injury, health outcome, soreness, missed personal record, or other consequence arising from your use of the app.
Tips & in-app purchases.
Home Gym Buddy is free. There is no subscription, no trial period, no free-trial-to-paid conversion, and no features locked behind a paywall. Every feature of the app is available to every user.
The app may offer optional, voluntary tips as non-consumable in-app purchases (Apple In-App Purchases). These tips:
- Are entirely voluntary — you never need to buy one to use any feature
- Do not unlock anything within the app
- Are processed by Apple and governed by the Apple Media Services Terms and Conditions
- Are non-refundable except as required by Apple's policies or by applicable law
If you have a problem with a tip purchase, contact Apple Support — refund requests for Apple In-App Purchases are handled by Apple, not by the developer.
Your content.
Any workout programs, spreadsheets, notes, and logs you create or import into Home Gym Buddy are yours. Because all data is stored locally on your device and never transmitted to us, we have no access to your content and no claim to it. We cannot back it up, restore it, or share it. We recommend exporting your program regularly to iCloud Drive or another location of your choice.
Disclaimer of warranties.
The app is provided "as is" and "as available", without warranty of any kind, either express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. We do not warrant that the app will be error-free, secure, free of viruses or other harmful components, or that defects will be corrected. Use of the app is at your sole risk.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.
Limitation of liability.
To the maximum extent permitted by applicable law, in no event will the developer be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including, without limitation, lost profits, lost data, personal injury, property damage, or training-related outcomes — arising out of or in connection with your use of, or inability to use, the app, even if the developer has been advised of the possibility of such damages.
To the extent any liability cannot be excluded under applicable law, the developer's total cumulative liability to you for all claims arising out of or relating to the app or these Terms will not exceed the amount you have paid to the developer in the twelve months preceding the claim — which, given the app is free, will typically be zero (excluding any optional tips processed through Apple).
Termination.
You may stop using Home Gym Buddy at any time by deleting it from your device. We may terminate or suspend distribution of the app at any time, for any reason, with or without notice. On termination, the license granted to you ends, but provisions that by their nature should survive — including disclaimers, liability limits, and governing-law clauses — will survive.
Changes to these terms.
We may update these Terms from time to time. The "effective and last updated" date at the top of this page reflects the most recent change. Continued use of the app after changes constitutes acceptance of the updated Terms. Material changes will be noted in the app's release notes on the App Store.
Severability & entire agreement.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Apple EULA and the Apple Media Services Terms, constitute the entire agreement between you and the developer regarding Home Gym Buddy and supersede any prior agreements.
Governing law.
These Terms are governed by the laws of the developer's jurisdiction of residence, without regard to its conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, except where applicable consumer-protection law requires otherwise — in which case the mandatory rules of your country of residence apply.
